On October 1, 2007 Florida's no-fault insurance laws will expire. By allowing these laws to expire, the Florida legislature has chosen to change the state to a tort-based automobile insurance system.
Under the current no-fault system, Personal Injury Protection (PIP) provide mandatory coverage for medical loss, rehabilitation expenses and essential services, as well as optional coverage for lost wages for certain injuries resulting from an automobile accident. With the new tort law, claims previously covered under your PIP coverage could now be covered under the at-fault driver's Bodily Injury coverage or your own optional Medical Payments or Uninsured/Underinsured Motorist coverages.
If your current policy includes Bodily Injury, Medical Payments, and/or, Uninsured Motorist coverage, there may be a small increase in premium for these coverages. However, by eliminating the Personal Injury Protection coverage, Florida policyholders will enjoy an overall savings on their total policy premium.
Only those policyholders whose policies were issued prior to October 1, 2007, and who wish to maintain their PIP benefits for the remainder of the policy period, will be able to retain PIP coverage; subsequent policies will not provide PIP benefits.
Medical Payment coverage pays for reasonable and necessary medical, dental, hospital and funeral expenses for you, relatives who reside in your household and any person using you vehicle with your permission. It also protects you and relatives who reside in your household, if injured while occupying another vehicle, or if struck as pedestrians. You may request to add this coverage through our web site. This coverage does not offer work loss and replacement services.
Important note:
If you elect to remove PIP coverage as of October 1, 2007, you will no longer have certain benefits such as medical loss, rehabilitation expenses and lost wages. In the event that Florida's motor vehicle no-fault law is extended or reenacted on or before October 1, 2007, we will ensure your policy meets all statutory requirements and will not process your request to remove the coverage.
